About This Tool

What happens after I submit?

After you submit your details, a 3-second countdown screen displays your brand name and class as a reminder. The official IP India Trade Marks Registry public search portal then opens automatically. On the portal, select Trademark as the search type, enter your brand name, optionally select the class, and click Search to view results.

What the search shows — and what it does not

The Trade Marks Registry database shows registered marks and pending applications filed before the Registry. It does not capture unregistered marks that may have acquired goodwill through use in India, prior rights held by foreign proprietors with Indian reputation, or very recent filings not yet indexed in the public database.

The Registry examines applications not only for identical marks but for marks that are deceptively similar — assessed on phonetic equivalence, visual resemblance, and structural similarity under Section 11 of the Trade Marks Act 1999. A search returning no identical results is the starting point for clearance, not its conclusion.

About the Nice Classification system

Indian trademark applications are filed under the Nice Classification, which divides goods and services into 45 classes — classes 1 to 34 for goods, classes 35 to 45 for services. Each application must specify the applicable class. Government fees are charged per class, and protection in one class does not extend to others. If you are unsure of the correct class, a trademark attorney can advise before filing.
